Terms
General terms for video editing services · Version: September 2026
1. Scope
These terms apply to video editing services provided by Marlon Cacciapuoti, trading as contentcreationmarlon („I“, „me“), to clients („you“). They apply to business clients and to consumers alike; where the rules differ for consumers, this is stated.
Anything we agree individually for a project, for example in the project confirmation, takes priority over these terms. Your own terms and conditions only apply if I agree to them in writing.
2. How a project is agreed
This website and the contact form are for information and first contact only. Sending an enquiry does not create a contract.
After we have talked about your project, I send you a project confirmation by email or chat message. It sets out the scope, the price, the delivery date and the number of revision rounds included. The contract is concluded when you accept this confirmation, for example by replying that you agree. The contract language is English, or German if we agree on it.
3. What you provide
You provide the raw footage, audio, graphics and any other material needed for the edit, in usable quality and in the way we agreed.
You make sure you hold the rights needed to use everything you send me, including music, fonts, stock footage and recordings of other people. If a third party makes a claim against me because material you supplied infringes their rights, and you are responsible for that infringement, you will indemnify me against the claim, including reasonable costs of legal defence.
If material arrives late or incomplete, the delivery date moves back accordingly.
4. Revisions and changes
The number of revision rounds included is stated in the project confirmation. A revision round is one collected list of change requests, sent together.
Changes that go beyond the agreed scope, such as a new concept, additional footage, a different format or a restructured video, are not revisions. I will quote them separately, and they are only carried out once you have agreed to the quote.
5. Prices and payment
The price is agreed in the project confirmation before work starts. Prices shown to consumers are final prices. Whether and how VAT applies is shown in the project confirmation and on the invoice.
Unless the project confirmation says otherwise, invoices are due within 14 days of receipt. For larger projects, we can agree a deposit in the project confirmation.
6. Rights to the finished video
Once the agreed fee has been paid in full, you receive the exclusive right to use the finished video, without limitation in time or territory, in all media, including on your channels and for commercial purposes. Until then, you may review the video but not publish it.
Material from third parties that I add, such as music, sound effects or stock footage, is only used if its licence covers your intended use. We will agree on this for each project.
Once you have published a video, I may show it as a reference, for example on this website or on social media. You can tell me at any time that you don’t want this, and I will remove it. I will never show unpublished material.
7. Project files
On request, I hand over the project files (for example the DaVinci Resolve project) together with the finished video. I keep project files for 30 days after final delivery; longer storage can be agreed. Please always keep your own copy of your raw footage.
8. Delivery dates
Delivery dates are set in the project confirmation and assume that I have received all material in time. If I can’t meet a date for reasons outside my control, such as illness or a technical failure, I will tell you straight away and we will agree a new date. Your statutory rights remain unaffected.
9. Cancellation
You can terminate the contract at any time before the video is finished (§ 648 of the German Civil Code, BGB). In that case I am entitled to the agreed fee, minus the expenses I save and anything I earn, or deliberately fail to earn, by using my time elsewhere. By law, I am presumed to be entitled to 5 % of the fee for the part of the work not yet done.
If you are a consumer, you also have the statutory right of withdrawal described in section 12. The right of either party to terminate for good cause remains unaffected.
10. Defects
If the finished video has a defect, you have the statutory rights. Please tell me about any problem as soon as you notice it, so I can fix it quickly.
11. Liability
I am liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body or health, under the German Product Liability Act, and where I have given a guarantee.
For slight negligence, I am only liable if I breach an essential contractual obligation, meaning an obligation that makes proper performance of the contract possible in the first place and on which you may regularly rely. In that case my liability is limited to the damage that is foreseeable and typical for this kind of contract.
I do not promise particular results such as views, reach, subscribers or revenue.
12. Consumers: right of withdrawal
If you are a consumer (§ 13 BGB) and we conclude the contract by email, chat or other means of distance communication, you have a statutory right of withdrawal. You will find the details and the model withdrawal form on the page Right of withdrawal, and I will also send them to you with the project confirmation.
If you want me to start work within the 14-day withdrawal period, I will ask you to request this expressly.
13. Confidentiality
I treat your material, plans and unpublished videos as confidential and do not pass them on to third parties. This continues after the project has ended.
14. Applicable law
German law applies. If you are a consumer and live in another country, you keep the protection of the mandatory provisions of the law of the country in which you live.
